Federal Judge Strikes Down Florida's Transgender Health Care Restrictions

A federal judge in Florida has permanently blocked a 2023 law that restricted gender-affirming care for transgender minors and imposed limitations on such treatment for adults. The law, Florida SB 254, prohibited transgender minors from receiving puberty blockers and hormonal treatments, even with parental consent, and restricted transgender adults from obtaining such treatments unless prescribed by a doctor. Additionally, the law banned online treatment for transgender adults.

Senior U.S. District Court Judge Robert Hinkle ruled that the state unlawfully targeted transgender individuals, violating their equal protection rights. The decision also indicated that the law was not based on scientific evidence. The challenge against the law was brought by several organizations, including GLAD, NCLR, the Human Rights Campaign Foundation, Southern Legal Counsel, and Lowenstein Sandler. Governor Ron DeSantis has called the ruling "erroneous" and announced plans to appeal. Despite the ruling, the prohibition on puberty blockers, cross-sex hormones, and surgeries for minors remains in effect.
