ACLU challenges Biden's new border crackdown

A coalition of immigrant advocacy groups has filed a lawsuit against the Biden administration over its new policy that halts asylum claims at the southern border. The lawsuit, led by the American Civil Liberties Union (ACLU) on behalf of organizations such as Las Americas Immigrant Advocacy Center and RAICES, challenges the legality of the new executive actions. These actions, announced by President Joe Biden, suspend asylum processing when border encounters exceed 2,500 per day. The restrictions will remain until two weeks after the daily encounter numbers fall to or below 1,500.

The lawsuit claims that the new measures are nearly identical to those implemented by former President Donald Trump, which also restricted asylum claims between ports of entry. The ACLU's lead attorney, Lee Gelernt, argued that Congress allows asylum seekers to request relief regardless of their point of entry. Despite the legal challenge, the lawsuit does not seek an emergency injunction to halt the policy's implementation. The Biden administration has stated it is prepared to defend the new rules in court.
